It is Ordered that the petitioner-respondent's motion is granted to the extent of vacating the stay of the enforcement of the final judgment and warrant of eviction. Respondent-appellant, pursuant to Appellate Term order dated August 18, 2016, shall perfect her appeal by no later than the December 2016 term, the filing deadline for which is October 11, 2016. In the event of respondent-appellant's failure to comply with aforementioned order, landlord-respondent may move, on five days' notice, for an order dismissing the appeal.
