DECISION & ORDER ON MOTION
FOR REINSTATEMENT

Motion by Kevin G. McKeon for reinstatement as an attorney and counselor-at-law. Mr. McKeon was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the First Judicial Department on February 25, 1974, under the name Kevin Garry McKeon. By opinion and order of this Court dated September 8, 1994, Mr. McKeon was suspended from the practice of law for a period of three years, effective immediately. By opinion and order of this Court dated May 22, 1995, Mr. McKeon was disbarred, pursuant to Judiciary Law § 90(4), following his plea of guilty in the United States District Court for the Eastern District of New York to one count of conspiracy to possess with intent to distribute narcotics in violation of 21 USC § 846, 21 USC § 841(b)(1)(B)(i), and 21 USC § 841(b)(1)(C), under Appellate Division Docket No. 1995-01978. By decision and order on motion of this Court dated October 1, 2007, Mr. McKeon's motion for reinstatement was held in abeyance and the matter was referred to the Committee on Character and Fitness to investigate and report on Mr. McKeon's current fitness to be an attorney.

Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the report of the Committee on Character and Fitness, it is

ORDERED that the motion is denied on the ground that the movant has abandoned the motion.
