DECISION & ORDER ON MOTION

Motion by the appellant to hold in abeyance an appeal from a judgment of the Supreme Court, Queens County, rendered December 22, 2014, pending determination of his application pursuant to CPL 450.15 and CPL 460.15 for leave to appeal to this Court from an order of the Supreme Court, Queens County, dated September 10, 2015. Separate motion by the appellant to consolidate the appeal from the judgment with the appeal from the order, in the event that leave to appeal to this Court from the order is granted.

Upon the papers filed in support of the motion to hold in abeyance the appeal from the judgment and the papers filed in relation thereto, and upon the papers filed in support of the motion to consolidate the appeals and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion to hold in abeyance the appeal from the judgment is denied as academic in light of the decision and order on application of this Court dated September 27, 2016, which granted the appellant's application for leave to appeal to this Court; and it is further,

ORDERED that the motion to consolidate the appeals is denied; and it is further,

ORDERED that on the Court's own motion, the appeals will be calendared together and will be argued or submitted on the same date.
