| ORDER ON APPLICATION |
Application by the defendant pursuant to CPL 530.45 to be released on bail after his conviction of criminal mischief in the third degree, in the County Court, Rockland County, upon a jury verdict, on September 26, 2016. The County Court, Rockland County, remanded the defendant pending the imposition of sentence.
Upon the papers filed in support of the application, the papers filed in opposition thereto, and upon hearing the attorneys for the respective parties, it is
ORDERED that the application is granted to the extent that pursuant to CPL 530.45 the defendant is released on bail pending imposition of sentence on condition that the defendant complies with the terms of the order of protection of the County Court, Rockland County, dated May 25, 2016, and the defendant's bail is set by the giving of an insurance company bail bond in the amount of $25,000 or by depositing the sum of $15,000 as a cash bail alternative, and the application is otherwise denied; and it is further,
ORDERED that this order shall terminate and be of no further effect upon the imposition of sentence or upon the defendant's failure to appear for sentence; and it is further,
ORDERED that upon receipt of a copy of this order on application together with proof that the defendant has given an insurance company bail bond in the amount of $25,000 or deposited the sum of $15,000 as a cash bail alternative, the Warden of the facility at which the defendant is incarcerated, or his or her agent, is directed to immediately release the defendant; and it is further,
ORDERED that counsel for the defendant shall serve a copy of this order, by mail, on the Clerk of the County Court, Rockland County.
