| DECISION & ORDER ON MOTION |
Motion by the respondent, inter alia, in effect, to dismiss an appeal from an order of the Supreme Court, Queens County, entered April 18, 2016, on the ground that the appellant is not aggrieved by the order.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is, in effect, to dismiss the appeal on the ground that the appellant is not aggrieved by the order appealed from is granted, and the appeal is dismissed, without costs or disbursements (see CPLR 5511; Pennsylvania General Ins. Co., v Austin Powder Co., 68 NY2d 465, 472-473); and it is further,
ORDERED that the motion is otherwise denied as academic.
