In the Matter of Riley C. P. (Anonymous).

St. Vincent's Services, petitioner-respondent;

Tyrone P. (Anonymous), respondent-appellant,

et al., respondent.

(Docket No. B-15560-15)

DECISION & ORDER ON MOTION

Appeal by Tyrone P. from a purported order of the Family Court, Kings County, dated June 9, 2016. By order to show cause dated August 26, 2016, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled proceeding on the ground that there is no order of the Family Court, Kings County dated June 9, 2016, in the above entitled matter.

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that on the Court's own motion, the notice of appeal dated July 7, 2016, is deemed to be a notice of appeal from an order of the Family Court, Kings County, dated June 1, 2016 (see CPLR 5520[c]); and it is further,

ORDERED that the motion to dismiss the appeal is denied.

BALKIN, J.P., HALL, SGROI and BARROS, JJ., concur.
