| DECISION & ORDER ON MOTION |
Proceeding pursuant to CPLR article 78 in the nature of prohibition to prohibit the enforcement of an eavesdropping warrant dated September 16, 2014, and application by the petitioner for poor person relief.
On the Court's own motion, it is
ORDERED that the proceeding is transferred to the Appellate Division, First Department, pursuant to New York Constitution, article VI, § 4(I), for hearing and determination; and it is further,
ORDERED that all further proceedings in connection with the proceeding shall be conducted pursuant to the rules of the Appellate Division, First Department.
