Defendant-appellant having moved to consolidate the appeals taken herein from an order and an order and judgment of the Supreme Court entered in the Office of the Clerk of the County of Erie on December 3, 2015 (docket No. CA 16-01508), and March 11, 2016 (docket No. CA 16-01731), and for other relief,
Now, upon reading and filing the affirmation of Peter H. Wiltenburg, Esq., dated October 3, 2016, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks to consolidate the appeals is denied, and
It is further ORDERED that the appeal taken from the order entered December 3, 2015, is removed from the term of this Court commencing February 27, 2017, and is added to the term of this Court commencing April 3, 2017, to be argued and determined together with the appeal from the order and judgment entered March 11, 2016.
