Motion by appellant to be restored to possession of the subject apartment pending the determination of an appeal from an order of the Civil Court of the City of New York, Queens County, entered September 23, 2016, or for alternative relief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that motion is granted and respondent is directed to restore appellant to possession forthwith.
