DECISION & ORDER ON MOTION

2016-2568 S CR
The People of the State of New York, Appellant, v
Edwin E. Reyes, Respondent.

On the court's own motion, it is

ORDERED that this appeal from an order of the District Court of Suffolk County, Suffolk County Traffic and Parking Violations Agency, entered September 29, 2016, is stricken from the general calendar.

The order appealed from granted respondent's oral motion to dismiss the accusatory instrument, referencing various statements that were made on the record, and the affidavit of errors does not adequately set forth what occurred at the proceedings. Under these particular circumstances, a transcript of the proceedings is necessary for the appeal to be properly perfected.
