| DECISION & ORDER ON MOTION |
Motion by the respondent Mendel Brach to strike stated portions of the record on an appeal from an order of the Supreme Court, Kings County, dated August 2, 2016, and to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to strike stated portions of the record is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof; and it is further,
ORDERED that the branch of the motion which is to enlarge the respondent Mendel Brach's time to serve and file a brief is granted, the respondent Mendel Brach's time to serve and file a brief is enlarged until November 28, 2016, and the brief must be served and filed on or before that date.
