DECISION & ORDER ON MOTION

2014-2297 S CR
The People of the State of New York, Respondent, v Jordan Taffet, Appellant.

Motion by appellant for leave to reargue so much of an appeal as was from a judgment of the Justice Court of the Village of Ocean Beach, Suffolk County, rendered October 6, 2014, convicting appellant of violating Village of Ocean Beach Code § 127-4 (A), which appeal was determined by decision and order of this court dated February 22, 2016.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted and, upon reargument, the decision and order of this court dated February 22, 2016 (50 Misc 3d 142[A], 2016 NY Slip Op 50208[U]) are recalled and vacated, and a new decision and a new order are substituted therefor (see appeal No. 2014-2297 S CR, decided simultaneously herewith).
