DECISION & ORDER ON MOTION

Motion by Michael Ira Josephs, inventory attorney with respect to the above-entitled matter appointed by decision and order on motion of this Court dated November 25, 2013, for authorization to destroy any remaining unclaimed files, for leave to deliver banking and bookkeeping records in his possession as inventory attorney in the above-entitled matter to the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts, and to be discharged. Percy A. Randall, Jr., was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on June 22, 1983. By decision and order on motion dated December 20, 2011, this Court immediately suspended Mr. Randall from the practice of law, pursuant to Judiciary Law § 90(4)(f), as a result of his conviction of a serious crime, and authorized the Grievance Committee to institute and prosecute a disciplinary proceeding. By opinion and order of this Court dated October 2, 2013, Mr. Randall was suspended from the practice of law for a period of two years, effective immediately (see Matter of Randall, 112 AD3d 1). By opinion and order of this Court dated September 2, 2015, in a separate proceeding under Appellate Division Docket No. 2015-04453, Mr. Randall's name was stricken from the roll of attorneys and he was disbarred from the practice of law effective January 22, 2015, pursuant to Judiciary Law § 90(4)(b), based upon his conviction of grand larceny in the second degree, in violation of Penal Law § 155.40(1), a class C felony (see Matter of Randall, 132 AD3d 177).

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that Michael Ira Josephs is authorized to arrange for the destruction of any unclaimed files under the guidance of Robert P. Guido, Executive Director for Attorney Matters, and shall provide the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts with a record of all files inventoried; and it is further,

ORDERED that Michael Ira Josephs is authorized to deliver all banking and bookkeeping records in his possession as inventory attorney in the above-entitled matter to the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts; and it is further,

ORDERED that upon completion of the foregoing, Michael Ira Josephs is discharged as inventory attorney in the above-entitled matter.
