DECISION & ORDER ON MOTION

Motion by the appellant for leave to withdraw his excessive sentence motion on an appeal from a judgment of the Supreme Court, Kings County, rendered June 30, 2015, and for leave to serve and file a brief on the appeal.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is granted, the appellant's excessive sentence motion and the respondent's response to the motion are deemed withdrawn, the appellant's time to serve and file a brief is enlarged, and the appellant shall serve and file a brief expeditiously in accordance with this Court's rules (see 22 NYCRR 670.1, et seq.) and written directions.
