| DECISION & ORDER ON MOTION |
Motion by the appellant on appeals from three orders of the Supreme Court, Queens County, two dated June 19, 2015, and one dated November 30, 2015, inter alia, in effect, for summary reversal of the orders based upon the respondent's default. Separate motion by the appellant, inter alia, to enlarge the record to include a certain "Declaration for Common Traverse in Support of Permanent Restraint," and, in effect, to enlarge the time to comply with a decision and order on motion of this Court dated June 27, 2016. Motion by the respondent, inter alia, to dismiss the appeals on the ground that appellant failed to comply with the decision and order on motion of this Court dated June 27, 2016.
Upon the papers filed in support of the appellant's motions and no papers having been filed in opposition or in relation thereto, and upon the papers filed in support of the respondent's motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the appellant's second motion which is, in effect, to enlarge the time to comply with a decision and order on motion of this Court dated June 27, 2016, is granted, and on or before December 12, 2016, the appellant shall serve and file a supplemental record containing papers filed by the respondent in support of its motion for summary judgment, the papers filed by the appellant in support of the appellant's motion for renewal, including the order to show cause, and the respondent's papers filed in opposition to the motion for renewal; and it is further,
ORDERED that the motions are otherwise denied; and it is further,
ORDERED that on the Court's own motion, the respondent's time to serve and file a brief is enlarged until January 17, 2017, and the respondent's brief must be served and filed on or before that date.
