Motion by the petitioner to approve and so-order a stipulation in a proceeding pursuant to General Municipal Law § 712, in effect, to determine whether the proposed annexation by the City of Middletown of certain real property located in the Town of Wallkill is in the overall public interest.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied.
