DECISION & ORDER ON MOTION

Motion by the appellant for leave to prosecute an appeal from a judgment of the County Court, Westchester County, dated July 14, 2016, as a poor person and for the assignment of counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that on the Court's own motion, the appeal and motion are transferred to the Appellate Term of the Supreme Court, Ninth and Tenth Judicial Districts, for determination by that court; and it is further,

ORDERED that all further proceedings in connection with the appeal shall be conducted pursuant to the rules of the Appellate Term, Ninth and Tenth Judicial Districts.
