On the Court's own motion, it is
ORDERED that the decision and order on application of this Court dated July 26, 2016, in the above-entitled appeal is recalled and vacated and the following decision and order on application is substituted therefor:
Application by the appellant to withdraw an appeal from an order of the Supreme Court, Suffolk County, dated August 7, 2015, insofar as taken against the respondent M & G Bakery, doing business as Park Bake Shop.
Upon the stipulation of the attorneys for the respective parties to the appeal dated July 6, 2016, it is
ORDERED that the application is granted and the appeal insofar as taken against the respondent M & G Bakery, doing business as Park Bake Shop, is deemed withdrawn, without costs or disbursements.
