DECISION & ORDER ON MOTION

Motion by appellant to reinstate an appeal from an order of the Civil Court of the City of New York, Kings County, entered December 10, 2014, which was dismissed without prejudice by decision and order on motion of this court dated June 10, 2016, and to reinstate a stay granted by decision and order on motion of this court dated April 17, 2015 pending the determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and the appeal shall be perfected by January 6, 2017; and it is further,
ORDERED that the stay granted by decision and order on motion of this court dated April 17, 2015 is reinstated and continued on condition that appellant perfect the appeal by January 6, 2017; and it is further,
ORDERED that in the event that the above condition is not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
