The People of the State of New York, Respondent, v Angelo Passalacqua, Appellant.

Motion by appellant for leave to prosecute an appeal from a judgment of conviction of the Justice Court of the Village of Patchogue, Suffolk County, rendered March 23, 2016, as a poor person, for the assignment of counsel, and for an enlargement of time to file an affidavit of errors.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is denied without prejudice to renewal upon appellant setting forth a proper basis for relief pursuant to CPL 460.30.
