Counsel for appellant having moved to be relieved of assignment on the appeal taken herein from an order of the Family Court, Monroe County, entered in the Office of the Clerk of said Court on January 8, 2016,
Now, upon reading and filing the affirmation of Eftihia Bourtis, Esq., dated October 19, 2016, the notice of motion with proof of service thereof, and the statement of William M., dated November 21, 2016, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted, and the order entered April 22, 2016, assigning Eftihia Bourtis, Esq. to conduct the appeal and permitting respondent-appellant to appeal as a poor person is vacated, and
It is further ORDERED that respondent-appellant shall file the original and ten copies of the stipulated or settled record and ten briefs on the appeal, together with proof of service, on or before February 21, 2017, and in the event of failure to so perfect the appeal is hereby dismissed without further order.
