DECISION & ORDER ON MOTION

Appeal by Ariel Williams from an order of the County Court, Westchester County, dated August 29, 2016. By order to show cause dated October 18, 2016, the appellant was directed to show cause before this Court why an order should or should not be entered dismissing the appeal purportedly taken as of right on the ground that the order dated August 29, 2016, was neither appealable by right nor by permission. Motion by the appellant to stay all proceedings in a certain action pending in the Justice Court, Town of Somers, Westchester County.

Now, upon the order to show cause and the papers filed in response thereto, and upon the papers filed in support of the appellant's motion and the papers filed in opposition thereto, it is

ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed, without costs or disbursements (see CPL 450.10, 450.20); and it is further,

ORDERED that the appellant's motion is denied as academic.
