DECISION & ORDER ON MOTION

Motion by Shamma Dieujuste, inter alia, for leave to appeal to this Court from an order of the Supreme Court, Rockland County, dated October 25, 2016, to deem the papers filed in connection with this motion to be a timely notice of appeal from the order in the event that leave to appeal is unnecessary, and to direct the defendant East Ramapo Central School District to produce certain disciplinary records.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branches of the motion which are for leave to appeal and to deem the motion to be a timely notice of appeal are denied as unnecessary; and it is further,

ORDERED that on the Court's own motion Shamma Dieujuste's time to serve and file a notice of appeal is enlarged until December 29, 2016, and on or before that date Shamma Dieujuste shall serve and file a notice of appeal with the Rockland County Clerk, and file proof of filing with this Court (see CPLR 5514[a]); and it is further,

ORDERED that the motion is otherwise denied.
