DECISION & ORDER ON MOTION FOR REINSTATEMENT

Motion by Donnahue G. George to "reconsider[ ] and vacat[e]" a decision and order on motion of this Court dated March 27, 2008, which immediately suspended him, and an opinion and order of this Court dated December 16, 2008, which disbarred him, upon default, and to reinstate him to the Bar. Mr. George was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on May 19, 2004. By decision and order on motion of this Court dated March 27, 2008, Mr. George was immediately suspended, pursuant to 22 NYCRR 619.4(l)(1)(i), upon a finding that he was guilty of serious professional misconduct immediately threatening the public interest based upon his failure to comply with the lawful demands of the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts; the Grievance Committee was authorized to institute and prosecute a disciplinary proceeding against him, and the issues raised were referred to the Honorable Herbert Altman, as Special Referee, to hear and report. By opinion and order of this Court dated December 16, 2008, Mr. George was disbarred upon his default, and his name was stricken from the roll of attorneys and counselors-at-law, effective immediately.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.

We find that Donnahue G. George does not demonstrate the requisite character and fitness to practice law.
