It is Ordered that the defendant-respondent's motion seeking to dismiss the appeal of the decision/order (Miles, J.), dated September 4, 2015 is granted, unless plaintiff-appellant perfects its appeal by no later than the April 2017 term - the filing deadline for which is February 8, 2017. In the event of plaintiff-appellant's failure to comply with the foregoing condition, defendant-respondent may move on five days notice for an order dismissing the appeal.
