| DECISION & ORDER ON MOTION |
Motion by the respondent-appellant pro se for leave to prosecute an appeal from an order of the Family Court, Kings County, dated August 29, 2016, as a poor person and for the assignment of counsel. By order to show cause dated October 20, 2016, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled proceedings on the ground that the respondent-appellant was not aggrieved by the order dated August 29, 2016, and the respondent-appellant's motion was held in abeyance in the interim.
Now, upon the order to show cause and no papers having been filed in response thereto, and upon the papers filed in support of assigned counsel's motion and the papers filed in relation thereto, it is
ORDERED that the motion to dismiss the appeal is granted and the appeal is dismissed (see CPLR 5511); and it is further,
ORDERED that the respondent-appellants motion is denied as academic.
