DECISION & ORDER ON MOTION

2016-11273

In the Matter of Jean B. (Anonymous),

appellant-respondent, v Jerome C. (Anonymous),

Jr., respondent-appellant.

(Docket Nos. O-1134-16, V-497-16/16A,

V-497-16/16B)

Motion by Jeanne M. M., also known as Jean B., on an appeal from an order of the Family Court, Rockland County, dated August 29, 2016, and an appeal and cross appeal from an order of the same court dated August 30, 2016, to stay enforcement of the orders pending hearing and determination of the appeals and cross appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that on the Court's own motion, the cross appeal from the order dated August 30, 2016, is dismissed, without costs or disbursements, on the ground that Jerome C., Jr., is not aggrieved by so much of the order as granted his cross motion to dismiss the Family Offense petition and vacate the temporary order of protection under Family Court Docket No. O-1134-16, and denied the motion by Jeanne M. M., also known as Jean B., to modify custody (see CPLR 5511), and on the further ground that the remaining portions of the order are not appealable as of right and leave to appeal has not been granted (see Family Ct Act § 1112); and it is further,

ORDERED that the motion is denied.

RIVERA, J.P., SGROI, DUFFY and BRATHWAITE NELSON, JJ., concur.
