Motion by the respondent for leave to serve and file a replacement brief on an appeal from a judgment of the Supreme Court, Queens County, rendered February 20, 2013.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, the respondent's brief and the appellant's reply brief are stricken, and on or before December 30, 2016, the respondent's shall serve and file the replacement brief; and it is further,
ORDERED that the appellant shall serve and file a replacement reply brief, if any, on or before January 6, 2017.
