The People of the State of New York, Appellant, v Alexander D. Zelaya, Respondent.

Motion by respondent to dismiss an appeal from an order of the District Court of Suffolk County, Suffolk County Traffic and Parking Violations Agency, entered September 4, 2015. Cross motion by appellant for a writ of error coram nobis seeking an extension of time to file an affidavit of errors.

Upon the papers filed in support of the motion and cross motion, and the papers filed in opposition thereto, it is

ORDERED that respondent's motion is granted and the appeal is dismissed (see People v Smith, 27 NY3d 643 [2016]); and it is further,

ORDERED that appellant's cross motion is denied.
