2016-06144 In the Matter of Rita Sachs, respondent, v Arye Sachs, appellant. (Docket No. O-8371-13)
| DECISION & ORDER ON MOTION |
Motion by the appellant pro se for leave to prosecute an appeal from an order of the Family Court, Nassau County, dated June 6, 2016, as a poor person and for the assignment of counsel. By order to show cause dated August 29, 2016, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled proceeding on the grounds that (1) the appeal from so much of the order as denied the appellant's motion to vacate an order of protection entered June 17, 2014, has been rendered academic as the order of protection has expired by its terms, and (2) the appellant is not aggrieved by so much of the order as denied the petitioner's cross motion to extend the order of protection and as granted the attorney for the children's application to be relieved.
Now, upon the order to show cause and the papers filed in response thereto, and upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed, without costs or disbursements; and it is further,
ORDERED that the appellant's motion is denied as academic.
RIVERA, J.P., ROMAN, COHEN and MILLER, JJ., concur.
