DECISION & ORDER ON MOTION

2015-2478 S CR
The People of the State of New York, Respondent, v Jason A. Faraone, Appellant.

Motion by respondent to expand the record on an appeal from a judgment of conviction of the District Court of Suffolk County, First District, rendered October 13, 2015, to include a transcript of the District Court proceedings held on June 20, 2013, and for an enlargement of time to serve and file a respondent's brief.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the branch of the motion seeking to expand the record on appeal to include the transcript of the District Court proceedings held on June 20, 2013 is granted, the matter is stricken from the general calendar and the appeals calendar, the appellant's brief shall be returned to appellant's counsel, and the record shall be remitted to the District Court for settlement of the aforesaid transcript; and it is further,

ORDERED that the branch of the motion seeking an enlargement of time to serve and file a respondent's brief is denied as academic.
