DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Peter J. Goldmann, Appellant.

Motion by appellant on an appeal from a judgment of conviction of the District Court of Suffolk County, Suffolk County Traffic and Parking Violations Agency, rendered January 19, 2017, in effect, to compel the District Court, pursuant to CPL 460.10 (3), to file an amended return on the affidavit of errors, or, in the alternative, for summary reversal of the judgment of conviction, or, in the alternative, for an enlargement of time to perfect the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branches of the motion seeking, in effect, to compel the District Court to file an amended return on the affidavit of errors, or, in the alternative, summary reversal of the judgment of conviction are denied; and it is further,

ORDERED that the branch of the motion seeking an enlargement of time to perfect the appeal is granted and appellant's time to perfect the appeal is enlarged to February 16, 2018.
