| DECISION & ORDER ON MOTION |
Motion by the appellant pursuant to CPLR 1021 to appoint Joseph Ragusa as successor executor of the estates of Philip Ragusa, Connie Ragusa, and Jean Ragusa and to be substituted for the deceased defendant on an appeal from an order of the Supreme Court, Kings County, dated October 9, 2014.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied without prejudice to making a motion for the relief sought in an appropriate forum, and then making an appropriate substitution in this Court.
