| DECISION & ORDER ON MOTION |
Motion by the respondent to be provided with the transcript of the grand jury proceedings on an appeal from an order of the Supreme Court, Nassau County, entered April 11, 2016, and to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and upon the consent of the appellant, it is
ORDERED that the motion is granted; and it is further,
ORDERED that on or before January 30, 2017, the appellant shall provide the respondent's counsel with a copy of the transcript of the minutes of the grand jury proceedings, the respondent's attorney shall keep the transcript confidential, and shall not disclose the contents of the transcript to anyone, except in the respondent's brief, which shall be marked confidential; and it is further,
ORDERED that the respondent's time to serve and file a brief is enlarged until March 2, 2017, and the respondent's brief must be served and filed on or before that date.
