DECISION & ORDER ON MOTION

Motion by U.S. Bank, N.A., to be substituted for Wells Fargo Bank, N.A., on an appeal from an order of the Supreme Court, Nassau County, entered June 8, 2015, or for leave to file a brief as a respondent on the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied without prejudice to renew after the Supreme Court, Nassau County, determines its motion for substitution; and it is further,

ORDERED that on the Court's own motion, the respondent's time to serve and file a brief is enlarged until February 10, 2017, and the respondent's brief must be served and filed on or before that date.
