Plaintiff having moved for poor person relief or, in the alternative, an order affirming Supreme Court's order granting poor person relief, and for an order directing Erie County to pay costs associated with the production and service of her briefs for this appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Erie on June 10, 2015,
Now, upon reading and filing the affidavit of Carey C. Beyer, Esq., sworn to December 30, 2016, the affidavit of Luam K. Abraha sworn to December 29, 2016, the notice of motion with proof of service thereof, and the affidavit of Kristen M. Walder, Esq., sworn to January 5, 2017, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is denied insofar as it seeks costs (see CPLR 1102; Carter v County of Erie [255 AD2d 984, 985]), and
It is further ORDERED that the motion is otherwise denied as unnecessary.
