DECISION & ORDER ON MOTION

Motion by the petitioner, inter alia, to reinstate a proceeding pursuant to CPLR article 78 in the nature of mandamus to compel the respondent, Nancy T. Sunshine, County Clerk, Kings County, inter alia, to calendar motions filed in an action entitled Bassile v Myers, pending in the Supreme Court, Kings County, under Index No. 41439/04, which proceeding was dismissed by decision, order, and judgment of this Court dated October 12, 2016.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied.
