DECISION & ORDER ON MOTION FOR REINSTATEMENT

Motion by Ruth M. Pollack for reinstatement as an attorney and counselor-at-law. Ms. Pollack was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on on October 26, 1983, under the name Ruth Marie Pollack. By decision and order on motion of this Court dated June 23, 2009, Ms. Pollack was immediately suspended from the practice of law pursuant to Judiciary Law § 90(4)(f), as a result of her conviction of criminal contempt, a "serious crime" as defined by Judiciary Law § 90(4)(d) and former 22 NYCRR 691.7(b); the Grievance Committee for the Tenth Judicial District was authorized to institute and prosecute a disciplinary proceeding against her; and the issues raised by the petition and any answer were referred thereto to the Honorable James A. Gowan, as Special Referee, to hear and report. By decision and order on motion of this Court dated January 12, 2011, the Honorable James A. Gowan was relieved as Special Referee, and the matter was reassigned to the Honorable Arthur J. Cooperman, as Special Referee, to hear and report. By opinion and order of this Court dated August 14, 2013, Ms. Pollack was disbarred, effective immediately, based on two charges of professional misconduct (see Matter of Pollack, 110 AD3d 119).

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied as premature (see 22 NYCRR 1240.16[c][1]; former 22 NYCRR 691.11).
