| DECISION & ORDER ON MOTION |
Motion by counsel assigned to represent the nonparty-appellants in the Supreme Court, Nassau County, to be relieved as counsel on an appeal from an order of the Supreme Court, Nassau County, dated August 17, 2016, to allow the nonparty-appellants to prosecute the appeal as poor persons, and for the assignment of new counsel.
Upon the papers filed in support of the motion and the papers filed in opposition thereto; it is
ORDERED that the motion is referred to the Supreme Court, Nassau County, for determination, which shall include the assignment of new counsel for the nonparty-appellants following a determination as to whether the parties are financially able to pay the fees for the newly assigned counsel or whether compensation should be pursuant to Judiciary Law § 35; and it is further,
ORDERED that the Supreme Court shall hear and determine with all convenient speed, and shall file a report with this Court advising of its determination of the motion when new counsel has been assigned.
