ORDERED that the order on application of this Court dated January 19, 2017, in the above-entitled appeal from an order of the Supreme Court, Kings County, dated March 31, 2016, which enlarged the time of the third-party defendant-respondent Benedetto & Sons Excavating, Inc., to serve an file a brief is amended by deleting from the decretal paragraph thereof the date "February 20, 2017," and substituting therefor the date "February 21, 2017."
