| DECISION & ORDER ON MOTION |
Motion by the respondent to dismiss an appeal from an order of the Supreme Court, Suffolk County, dated April 15, 2016, in effect, for failure to comply with a decision and order on motion of this Court dated October 25, 2016.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that on the Court's own motion, the respondent's time to serve and file a replacement brief is enlarged until February 27, 2017, and the respondent's replacement brief must be served and filed on or before that date; and it is further,
ORDERED that on the Court's own motion, the appellant's time to serve and file a reply brief is enlarged until March 14, 2017, and the reply brief must be served and filed on or before that date.
