DECISION & ORDER ON MOTION

Motion by the appellant to direct his former counsel to turn over his legal file on an appeal from an order of the Family Court, Suffolk County, dated September 9, 2016, and for an award of costs and an attorney's fee.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is

ORDERED that the branch of the motion which is to direct the appellant's former counsel to turn over the appellant's legal file is denied as academic; and it is further,

ORDERED that the motion is otherwise denied.
