An appeal having been taken to this Court from the order of the Supreme Court, Appellate Term, First Department, entered on or about October 29, 2015, And petitioner-respondent having moved for dismissal of the aforesaid appeal, and to vacate an existing stay of execution of the warrant of eviction, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted, the appeal is dismissed, and the stay of execution of the warrant of eviction issued by the Appellate Term, First Department, is vacated five days from the date of entry hereof.
