DECISION & ORDER ON MOTION

Motion by Darius Burris for leave to appeal to this Court from an order of the Supreme Court, Nassau County, dated November 1, 2016, for poor person relief, and for the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied as the order is not appealable by right or by permission (see CPL 450.10, 450.15); and it is further,

ORDERED that the motion is otherwise denied as academic.
