An appeal having been taken from the order of the Supreme Court, New York County, entered on or about April 21, 2009, And law firm Mitchell Silberberg & Knupp LLP having moved for leave to withdrawn as appellate counsel, and to stay the appeal for a period of time to be determined by this Court to allow defendants sufficient time to retain new counsel before this Court, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted to the extent of granting counsel for defendants leave to withdraw as appellate counsel (See CPLR 321[c]).
