| DECISION & ORDER ON MOTION |
Motion by the respondent to stay a disciplinary proceeding against him, pending the outcome of "collateral proceedings" to reverse his conviction of federal felonies in the United States District Court, Southern District of New York. By decision and order on motion dated June 19, 2015, this Court immediately suspended the respondent from the practice of law upon his conviction of a serious crime pursuant to Judiciary Law § 90(4)(f) based upon his conviction of the federal felonies, authorized the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts to institute and prosecute a disciplinary proceeding against the respondent, stayed the hearing in the disciplinary proceeding pending the respondent's release from incarceration, and directed the respondent to notify this Court when he was released. The respondent's counsel advised the Court by affirmation dated September 28, 2016, that the respondent had been released from incarceration. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on December 16, 1992.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that on the Court's own motion, so much of the decision and order on motion of this Court dated June 19, 2015, as stayed the disciplinary proceeding is vacated forthwith, and the parties are directed to proceed with the previously authorized hearing.
