DECISION & ORDER ON MOTION

Motion by the appellant, in effect, for a reconstruction hearing with respect to the respondent's trial exhibits, and to enlarge the time to perfect an appeal from a judgment of the Supreme Court, Kings County, dated September 15, 2014. By decision and order on motion of this Court dated October 14, 2016, the branch of the motion which was, in effect, for a reconstruction hearing was granted, the matter was remitted to the Supreme Court, Kings County, and the branch of the motion which was to enlarge the time to perfect the appeal from the judgment was held in abeyance in the interim. By order of the Supreme Court, Kings County, dated January 19, 2017, the respondent agreed to provide the appellant with certain exhibits within 45 days.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, and upon the order of the Supreme Court, Kings County, dated January 19, 2017, it is

ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal from the judgment is granted, the appellant's time to perfect the appeal is enlarged until April 10, 2017, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date; and it is further,

ORDERED that the motion is otherwise denied as academic.
