DECISION & ORDER ON MOTION

Motion by the appellant, in effect, to withdraw the excessive sentence motion filed by former assigned counsel on an appeal from a judgment of the County Court, Suffolk County, rendered December 2, 2014, and for leave to serve and file a brief on the appeal.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is granted, the excessive sentence motion filed by former assigned counsel is deemed withdrawn, the appellant's time to serve and file a brief is enlarged, and the appellant shall serve and file a brief expeditiously in accordance with this Court's rules (see 22 NYCRR 670.1, et seq.) and written directions.
