DECISION & ORDER ON MOTION

The People of the State of New York, Plaintiff, v
Joel Sarant, Defendant.

Motion by defendant, pursuant to CPL 460.30, for an extension of time to take an appeal from a judgment of conviction of the District Court of Suffolk County, Suffolk County Traffic and Parking Violations Agency, rendered September 12, 2016, and to stay the execution of the judgment of conviction and the suspension of defendant's motor vehicle operator's license.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion seeking an extension of time to take an appeal is granted, defendant's moving papers are deemed to constitute a timely notice of appeal and defendant's time to file an affidavit of errors is extended 30 days from the date of this decision and order on motion; and it is further,

ORDERED that defendant shall file a copy of the affidavit of errors in this court simultaneously with his filing the affidavit in the District Court; and it is further,

ORDERED that the branch of the motion seeking to stay the execution of the judgment of conviction and the suspension of defendant's motor vehicle operator's license is held in abeyance pending the timely filing of an affidavit of errors.
