DECISION & ORDER ON MOTION

Appeal by Vincent Logozzo from an order of the Supreme Court, Nassau County, dated August 22, 2016. By scheduling order dated December 19, 2016, the appellant's time to perfect the appeal was enlarged until January 27, 2016. The appellant has failed to perfect the appeal.

Now, on the Court's own motion, it is

ORDERED that the appeal is dismissed, without costs or disbursements, for failure to timely perfect in accordance with the rules (see 22 NYCRR 670.4[a][2],[4]) and prior order of the Court.
